If the indebtedness of any member to the Club is not paid within thirty (30) days after it becomes due,
the delinquent member may, without further notice or hearing, be suspended from the privileges of the Club,
and if such indebtedness is not paid within sixty (60) days after it becomes due, the delinquent member
may, without further notice or hearing, be expelled from the Club.
Article II, Section 2
1. Suspension. (a) If the indebtedness of any member is not paid within sixty (60) days after it becomes due, the membership of such member will, without further notice or hearing, be suspended. As a result, that member and other members included in the same membership – i.e. such member’s spouse or domestic partner in the case of a Joint Membership, and any Junior Members who derive their membership from such member – shall have none of the privileges of the Club during such suspension.
(b) A member will be reinstated only after full payment of the total outstanding balance.
(c) A member who is suspended for the second time or more in a twelve-month period will be reinstated three months after full payment of the total outstanding balance.
(d) Members who are suspended from Club privileges for financial reasons can be dining guests of members, but may not be guests of members for use of the athletic facilities during their suspension.
2/27/25: Adopted by the Board, revising and simplifying prior similar policy. Note that until September 2018, suspensions for financial delinquency required Board action.
2. Expulsion. If, at the time of three Monthly Meeting Dates (whether or not consecutive) in any 12-month period, a member remains suspended for financial delinquency and has an outstanding, unpaid balance, the Board will, without further notice or hearing, expel that member from the Club on such third Board meeting date.
2/27/25: Slightly reworded to clarify that the delay of reinstatement for suspension pursuant to subsection 1(c) does not make it impossible to avoid expulsion.
"Monthly Board Meeting Date" in this Section 2 means the fourth Thursday of each month, whether or not a Board meeting is actually held on that date, provided that if a Board meeting that would otherwise have been held on the fourth Thursday of a month is not skipped, but merely delayed for up to three weeks, the date of the actual meeting will be treated as a "Monthly Board Meeting Date." Thus if the Board holds no meeting in November, a meeting on December 3rd, and the next meeting on the fourth Thursday in January, there would be "Monthly Board Meeting Dates" on the fourth Thursday in October, December 3rd, the fourth Thursday in December and the fourth Thursday in January.
3. Process at Board Meeting. Staff should prepare for each Board meeting an expulsion list, setting forth the names of those members (if any) who have met the conditions set forth in the Bylaws for expulsion. At each meeting when an expulsion list is presented, a Board member should make a motion to expel the members on the expulsion list prepared by staff. Such motion need not name the members on the expulsion list, and the expulsion list need not be an attachment to the minutes. If the Board wishes to consider one or more of the members on the lists separately from the others, more than one motion may be made as to each list.
Member A's bill for the month of March totals $300. This bill is due April 30. He makes no payment. His bill at the end of April totals $500: the $300 balance forward, and late fees and other charges of $200. He continues to make no payments and to incur similar charges, so that he receives a bill at the end of May for $700 and at the end of June for $900.
At 2:00 pm on the fourth Thursday in July, he makes a $400 payment, which is applied to pay his March bill (which was due April 30) in full, and to pay $100 of the additional charges he incurred in April. That evening, the Board meets. Though more than 2-1/2 months have now passed since April 30, he is not suspended, because the indebtedness that was due May 31 was paid before the meeting.
When the Board next meets on the fourth Thursday in August, $100 that was due on June 30 remains unpaid. The Board suspends him at its August meeting.
He continues to make no payments, and remains suspended on the fourth Thursday in September (one) and October (two). The Board does not meet on the fourth Thursday in November, due to Thanksgiving, but delays this meeting to December 5th. At 4:30 pm on December 5th, the member pays all outstanding amounts (including all balances forward and new charges shown on the bill he received at the end of October, which was due November 30). He also arranges for future bills to be paid automatically from his bank account. This brings an end to his suspension, and when the Board meets that evening, he is not expelled.
However, the automatic payments fail because he closes his bank account in December, and he makes no payments of his bill due December 31 or any later bills. He is suspended again at the Board meeting near the end of March. He remains suspended at the Board meeting on the fourth Thursday in April (three). The Board expels him at its April meeting.
Any member who has been expelled may apply for reinstatement, and the Board of Trustees may or may not reinstate
that member on whatever terms or conditions that the Board of Trustees may deem advisable,
provided that, if the Board of Trustees that expelled a member determined that such member would not be eligible for reinstatement,
such member shall not be reinstated by a later Board of Trustees, nor shall such member be admitted to any class of membership.
Article II, Section 3
1. Financial Delinquency. As to reinstatment from a financial suspension, see subsections 1(b) and 1(c) above.
As to reinstatement after a financial expulsion: Members who have been expelled for financial delinquency are ordinarily reinstated the first and second time they are expelled if they pay all outstanding amounts within three months after the expulsion, though the Board may refuse to do this. Members who are expelled for financial delinquency for longer than one year, or who have been expelled three times, should not be reinstated. Upon reinstatement of an expelled member, the Board may impose conditions or limitations on such member, and the Board may later suspend or expel such member for violating any condition or limitation so imposed.
10/27/22: Reinstated the membership of a member after his third expulsion for financial delinquency, conditioned upon the brother of the expelled member (himself a Resident Active member) taking sole responsibility for the expelled member's financial obligations to the Club, with the understanding that failure by the brother to make payments would be regarded as delinquency by the brother and subject him to discipline, and based on the Board's positive assessment of the brother's financial responsibility and good character generally.
Since 1998, only one other member has been reinstated after being expelled three times for financial delinquency. There have been two cases in which members have been reinstated more than three years after expulsion for financial delinquency, but the one-year limit has generally been followed.
2. Other. The Board should consider the MSP pursuant to which a member was expelled, together with whatever facts and circumstances the Board finds relevant, in determining whether or not to reinstate a member who was expelled for reasons other than financial delinquency.
The Board may bar non-members from the privilege of being guests of Members at the Club, without prior notice or a hearing.
July 22, 2021: Undescribed incident. Each of the following nonmembers is barred from entry to the Club as a guest of any member until such time as the Board determines otherwise: Evan Wolf, Nick Kostrinksy-Thomas, Marco Aaronson, Caden Huff, Nick Kalber, Vincent Burke, Blake Connor and Holt Whittier.
December 6, 2007: Undescribed incident. Joey Gilmore is barred from being the guest of any Member indefinitely.
July 27, 2006: Incident with guests in member speedboat at Club dock: Ban Heidi Chicoine and Jimmy Pliego as guests of anyone at the Club until October 10, 2006 due to their misbehavior at the Club on June 10.
March 2, 2006: Hot tub incident with non-permitted guests. The Non-Members known as Nick Ragland-Johnson, Michael North, Candace Chambers and Alia Tall are banned from entry to the Club as a guest of any Member until such time as the Board of Trustees revokes the ban.
Junior members, JSP members and Junior Development members shall be entitled to use of
such Club facilities as may be prescribed by the Board of Trustees.
Article I, Section 4
This provision means that Junior (and JSP) members' use of the Club may be restricted by the Board. The Board may, in effect, allow Juniors to use the Club only upon good behavior. Hence the following policy.
The General Manager is authorized to suspend a Junior member for up to one week if he or she determines the Junior member has engaged in inappropriate conduct upon the premises. The President is authorized to suspend a Junior member until the next Board meeting if he or she determines the Junior member has engaged in inappropriate conduct upon the premises (See Chapter 113).
7/22/21: Adopted preceding paragraph regarding temporary Junior suspension, expanding previous policy adopted 7/28/05.
In addition to rights enumerated herein, Active members shall have full privileges and use of all facilities of the Club.
Article I, Section 4
The interpretation noted above as to Junior members does not apply to Active members, as to whom discipline for conduct is generally available under the following two provisions.
Any member of the Club whom the Board of Trustees determines, in its sole discretion, has engaged in inappropriate conduct
upon the premises, or conduct which disturbs the harmony or impairs the good name or prosperity of the Club,
may, after hearing by the Board or its designee if desired by the member charged, be reprimanded, suspended from
membership or expelled from the Club by a two‑thirds vote of the entire voting membership of the Board of Trustees.
Any determination or action described in this Section and made by the Board of Trustees
(after a hearing, if desired by the member charged) shall be final, and shall not be subject to further review or appeal.
Article II, Section 1
The Bylaws require, before taking disciplinary action:
(i) That the member be offered the opportunity for a hearing. The hearing may be before the entire Board or "its designee." The "designee" has sometimes been the Executive Committee or another small group of approximately three Trustees. The Bylaws do not specify a place, time or any notice requirement as to the hearing. The place should ordinarily be at the Club, and the time and notice should be reasonable, in terms of allowing the member to appear. The Club is not, however, required to hold the hearing at whatever time the member prefers, or to allow him or her an extended time to prepare for it.
(ii) A "two-thirds vote of the entire voting membership of the Board of Trustees." Ordinarily, this means seven votes (it was six before the number of voting trustees increased from nine to ten in 2017).
2. Effect of Suspension. Members who are suspended from Club privileges for disciplinary reasons can be guests of members, unless otherwise determined by the Board in the course of imposing the suspension.
The Tennis Committee shall formulate rules and policies for access to, allocation of and use of tennis and pickleball courts, subject to approval of the Board of Trustees.
The Tennis Captain has the authority to enforce those rules.
The Tennis Captain has the authority to suspend members from the use of the courts for periods up to thirty (30) days.
Article VI, Section 6
See Chapter 120 et seq.
The following is a form of disciplinary resolution, with a "menu" of options from which the Board may wish to select in making a resolution to discipline a member. This is a guide only, and is not a complete list of all the actions that the Board may take.
Introduction
Option number 1 sets forth the three bases for discipline referred to in the Bylaws, and should be included (with one or all of options a, b and c) in all disciplinary resolutions.

has engaged in conduct which
b disturbs the harmony [and]

Suspension
5 The membership of __________ is suspended for a period [beginning on ________ __, 20__ and] ending on _____ __, 20__; during that period [s]he shall have none of the privileges of membership.
6 The membership of __________ is suspended for a period ending at such time as the Board of Trustees determines, in its sole discretion, that [his/her] behavior warrants an end to the suspension [(which shall not, in any event, be before _____ __, 20__)]; during that time [s]he shall have none of the privileges of membership.
7 __________ is barred from entry to the Club as a guest of any member during the period of [his/her] suspension.

18 Notwithstanding the foregoing: ____________ may apply to be admitted as a Senior Active Member of the Club at any time after [his/her] 25th birthday, and shall be eligible to be admitted as if [s]he had been expelled from Senior Active membership and were applying for reinstatement pursuant to Article II, Section 3 of the Bylaws, except that [s]he would be required to pay the initiation fee for transfer from JSP to Senior Active membership in the amount and on the schedule as if [s]he had transferred from JSP to Senior Active at age 25. In particular: [s]he could be admitted to Senior Active Membership by resolution of the Board of Trustees on whatever terms and conditions the Board of Trustees might deem advisable at that time.
19 The above determinations and actions are final, and are not subject to further review or appeal.
Item number 18 may be appropriate when the expelled member is a Junior or JSP. In the absence of this provision, such a member – unlike an active member who is expelled – would be entirely ineligible to be reinstated after his or her 25th birthday
